INFORMATION NOTE REGARDING THE PROTECTION OF PERSONAL DATA

In accordance with the requirements of EU Regulation no. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as „GDPR”) LIBRA INTERNET BANK S.A. has the obligation to process personal data that you provide in a safe manner and only for the specified purposes.

The purpose of data collection is to provide financial and banking services and to operate the online payment system LIBRAPAY, along with its related services. Your refusal will result in the impossibility of processing payments through LIBRA INTERNET BANK S.A., LIBRAPAY, and its related payment systems.

1. Processed Information

It is collected for the purpose of identifying users in the authentication process or for making payments. The collected information includes:

  • a) Personal data serving an identification function*.
  • b) Information regarding the bank card (card number, expiration date, cardholder’s name). During the data collection process, for maximum security, the security code will not be stored.
  • c) Information regarding the IP address, browser type/ operating system, or information collected through cookies.
  • d) Information regarding any inadvertencies found in the documents/statements submitted to the Bank.

*Includes information related to the client’s full name, phone number, email address.

Accuracy of the information

The accuracy, correctness, and updating of the information provided by users are their responsibility. If any of your data is incorrect, please inform us as soon as possible.

2. I acknowledge that I can exercise all rights provided by the GDPR, including the following:

  • a) Right of access to data: the right to obtain from the Bank, upon request and free of charge, confirmation as to whether or not data concerning me are being processed by it. This right can be exercised by sending a request to the email address protectiadatelor@librabank.ro, clearly stating your name.
  • b) Right to rectification: the right to obtain the rectification or updating of incomplete or inaccurate data.
  • c) Right to object: the right to object, on grounds relating to my particular situation, to the processing of data concerning me. LIBRA INTERNET BANK S.A. will continue processing under the conditions where it has a legal obligation or in cases where it demonstrates a legitimate interest that overrides my interests, rights, and freedoms, or the processing is for the purpose of establishing, exercising, or defending a legal claim in court.
  • d) Right to erasure: The Bank is obligated to erase the personal data of the data subject without undue delay if one of the cases mentioned in Article 17 of the GDPR applies.
  • e) Right to restriction of processing: can be obtained under the conditions provided by Article 18 of the GDPR.
  • f) Right to data portability: the data subject has the right to receive the personal data provided to the Bank in a structured, commonly used, and machine-readable format and to transmit those data to another controller.
  • g) Right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them.
  • h) Right to lodge a complaint with the supervisory authority: the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing to defend the rights guaranteed by law.

Other notices regarding the protection of personal data

Card Registration

In order to use the LibraPay service and related features, data regarding the bank card (card number, expiration date, cardholder’s name) will be stored. These data will not be disclosed to third parties, and for maximum security, the security code (CVV2, CVC2) will not be stored.

Quick payments (only by entering the security code CVC2/CVV)

By selecting the checkbox „Activate the quick payment option” present in the online payment form of LibraPay or by going through the steps that involve creating an account in the LibraPay Wallet application, the user gives their consent to activate the LibraPay Wallet account, through which online payments to LibraPay partner merchants can be made, solely by entering the security code CVC2 / CVV.

Money transfers

Through the Libra Mobile Banking and Libra Journey applications designed for mobile devices running on the Android operating system (minimum version 2.3.7) and iOS (minimum version 5.0), transfers in lei from card to card can be made. For this purpose, it is necessary that both the card from which the transfer is made and the card to which the transfer is made are issued under the MASTERCARD or VISA logo by a bank in Romania, and their currency is RON.

For each transfer between cards not issued by Libra Internet Bank, a processing fee of 0.95 lei will be charged. Transaction limits and thresholds cannot exceed 4000 lei per transaction per card or 4000 lei per month per card. The BANK reserves the right to unilaterally modify the amount of costs (including, but not limited to, the processing fee) and the transfer thresholds.

The responsibility for correctly filling in and verifying the data required for these transfers rests entirely with the user.

Card Validation

To use the money transfer service and related facilities, it is necessary to validate the bank card. For this purpose, a transaction in the amount of 0 lei will be conducted.

Information obtained from third parties

In order to provide all the advantages of the LibraPay service, information related to the user is collected from third parties, such as name, email address, phone number, products purchased through the LibraPay service, and order details.

Transaction Information

When using the processing service to perform a transaction, we may collect information about each transaction, including its value, descriptions of the goods or services purchased, delivery details, or information about the cards used.

Information about LibraPay usage

Through the LibraPay service, information about user interaction on the website can be collected to ensure online payment processing and ensure the security of online payments by applying anti-fraud filters. These may include: failed payment attempts, number of accesses and sections accessed, IP address, information regarding the operating system, browser of the device (computer, mobile phone) accessing the LibraPay service.

User Communication

Communications via email or other communication channels with the user may be retained for subsequent processing in order to respond to requests and improve our services.

The information collected to prevent fraud

In order to protect the user against fraud, phishing, or other abuses, information about user interactions with the LibraPay service may be collected to enable identity validation or to detect potentially fraudulent behaviors.

Usage of the service through third-party providers, merchants, or other entities

In the process of purchasing from a website that uses the LibraPay payment system, certain personal information (such as phone number, email address, description of purchased products, etc.) may be transmitted from the merchant to the LibraPay system to complete the transaction. We are not responsible for the actions of the merchant chosen by the customer and therefore not responsible for the information transferred using the LibraPay service.

Security Measures

The LibraPay online payment processing system takes necessary security measures to protect users against unauthorized access or unauthorized alteration, destruction, or disclosure of data stored through the LibraPay service.

The security of the LibraPay account also depends on maintaining the confidentiality of the associated password. Additionally, the account username or password should never be shared with anyone.

Subsequent Changes

LIBRA INTERNET BANK S.A. reserves the right to make changes to the terms and conditions presented without prior notice. The use of the LibraPay service implies the implicit knowledge and acceptance of our terms and conditions.

Exchange of Information

We will never provide our customers’ personal information to other companies or individuals outside of LIBRA INTERNET BANK S.A., without their consent. In the case of purchasing products and/or services through the LibraPay system, there is the possibility of providing certain information (such as the customer’s name, phone number, email address) to the merchant from whom the purchases are made, for the purpose of identifying the transactions.

Confidentiality

All data collected during visits to the website are processed in accordance with the applicable legal provisions in Romania. LIBRA INTERNET BANK S.A. commits to not disclose any information regarding users’ visits to the website, except in legal situations. LIBRA INTERNET BANK S.A. will not transmit any personal data entered on the website www.librapay.ro, wallet.librapay.ro, or within the Libra Mobile Banking and Libra Journey applications to any third party, in accordance with these „Terms and Conditions”.

Changes to this privacy clause that may occur in the future will be published on this webpage without prior notice. „The Terms and Conditions” constitute, in its entirety, an agreement between visitors or users and LIBRA INTERNET BANK S.A. regarding the use of the librapay.ro website and the LibraPay service.

Using the Service

The LibraPay service can be used by customers or partners of LIBRA INTERNET BANK S.A., as well as by any other individuals who wish to benefit from the services of LIBRA INTERNET BANK S.A. or to inform themselves about them. LIBRA INTERNET BANK S.A. reserves the right to modify the content and/or structure of the websites and mobile applications at any time and without prior notice.

No information present on these websites or in the mobile applications shall be considered as offers of products or services in general and banking, insurance, leasing, stock exchange products, although all efforts are made to provide customers or partners with up-to-date information.
